Receipt of this addendum presupposes your awareness of the conditions as set forth in this document. The renter shall, at his own cost and expense, during the term of rental, keep and maintain, in his own custody, the equipment in good condition and repair, reasonable wear and tear excepted, and shall at termination of rental, pay the owner compensation for replacement of such of the said equipment may be lost, stolen, missing or broken or damaged, by any cause whatsoever, whether due to renters fault or not. The renter further agrees to compensate the owner in rent for any time lost as a result of the replacement or the necessity for making repairs on said equipment. The acceptance of the return of the equipment is not a waiver by Props Unlimited, LLC for any claims that it may have against the renter, nor a waiver of claims for latent or patent damage to the equipment. It shall be lawful for the owner or its agents at all reasonable times to enter the premises upon which equipment is kept for the purpose of viewing the state and condition of said equipment. Rental fee of all equipment taken out must be paid for the period of time until it is returned. No allowance will be made for the reason that any part of it was not used. Responsibility for said equipment shall not be transferred to any other party without the consent of Props Unlimited, LLC. The party signing for the equipment becomes responsible for its preservation and prompt return. The renter agrees not to remove or cover the nameplate or tag on the equipment showing ownership in Props Unlimited, LLC. This agreement contains the entire understanding between the parties, including representations, and may not be modified except by another agreement in writing, signed by both parties of this agreement. No terms, representation or warranty, express or implied not herein set forth in writing shall bind Props Unlimited, LLC. IDEMNITY - The renter or lessee shall take proper safeguards for the prevention of accidents or injury to person or property. Renter shall indemnify and hold harmless the owner (Props Unlimited, LLC) for all claims, suits actions and all loss and expense including reasonable attorneys' fees, and costs and costs of lessor in protecting its rights or property under this agreement, or in suing the renter for a breach of agreement and, on account of injuries to, death of, the damage to the property of performance of the work undertaken by the renter. The lessee covenants that it will in respect of the equipment: (a) Pay the rentals promptly when due (b) assume responsibility for them at current replacement values, against fire and loss or damage from whatever cause arising out of, from or to, rental or equipment (c) on termination of this agreement return them to the lessor at the expense and risk of the lessee.
